Student Permits - A foreign national may not study in Canada unless he/she is in possession of a canada student visa. It should be noted, however, that if the course or study program lasts for six (6) months or less, a study permit is not required.

Foreign students must meet certain immigration requirements to obtain an Student Authorization to study in Canada.

Before you apply for a student authorization, you must be accepted as a student by an approved educational institution. The institution will decide if you meet its academic and language requirements.

Student authorization is a form issued by an immigration officer. It allows you, after admittance, to remain in Canada to take an academic, professional or vocational training course at an approved university, college or institution.

 

A Study Permit is not required in the following circumstances:

  • For a course or program with a duration of six months or less;
  • For a minor child already in Canada, whose parents have legal status in Canada, other than Visitor Status;
  • For the family or staff of a foreign representative to Canada.

A Study Permit is a document issued by Citizenship and Immigration Canada that allows a foreign individual to study in Canada for a limited time, generally at a specific Canadian educational institution and in a specific program.

Citizenship and Immigration Canada will normally issue a Study Permit if an applicant has received an acceptance letter from a qualified Canadian educational institution, and possesses sufficient funds to pay for tuition and living costs. In some cases, Citizenship and Immigration Canada may require applicants to undergo medical examinations and provide Police Clearance Certificates.

Citizenship and Immigration Canada generally issues Study Permits that are valid for the duration of the intended course of studies. However, international students studying in Montreal or another city in the Province of Quebec must renew their status each year International Students are considered Visitors in Canada. They must satisfy a Citizenship and Immigration Canada Officer at the Port of Entry that the purpose of their entry into Canada is of a temporary nature.

Working in Canada as an International Student

Citizenship and Immigration Canada allows International Students to work in Canada in limited situations. Students are required to arrive in Canada with sufficient money to live and pay their bills while studying. However, in some cases, a student may be able to work in Canada during the course of study:

  • On campus without a Work Permit;
  • Off campus with a Work Permit;
  • In Co-op and Internship Programs, where work experience is part of the curriculum, with a Work Permit.

In addition, spouses/common-law partners of international students are eligible to work in Canada while their partners study.

Upon graduation, international students are encouraged to obtain Canadian work experience. The Post-Graduation Work Permit Program allows international graduates to obtain a three-year open work permit so that they can stay and contribute to the Canadian work force.

Skilled workers are people who are selected as permanent residents based on their ability to become economically established in Canada.
Federal skilled worker applications are assessed for eligibility according to the criteria set out below.
For your application to be eligible for processing, you must:

  • include the results of your official language proficiency test, AND
  • have a valid offer of arranged employment, OR
  • have one year of continuous full-time paid work experience in at least one of the occupations list.

Work experience minimum requirements
If your application is eligible for processing, it will then be assessed against minimum requirements.
Your work experience must be:

  • for at least one year, continuous, and paid (full-time or the equivalent in part-time), AND
  • Skill Type 0 (managerial occupations) or Skill Level A (professional occupations) or B (technical occupations and skilled trades) on the Canadian National Occupational Classification (NOC) list, AND
  • within the last 10 years.

If you meet the above minimum requirements, your application will be processed according to the six selection factors in the skilled worker points grid, which are:

  • your education
  • your abilities in English and/or French, Canada’s two official languages
  • your work experience
  • your age
  • whether you have arranged employment in Canada, and
  • your adaptability.

Applicants must score a minimum of 67 out of the possible 100 points to qualify. You must also show that you have enough money to support yourself and your dependants after you arrive in Canada. You do not have to show that you have these funds if you have arranged employment in Canada.

Canadian Experience Class
You must meet these minimum requirements to apply for permanent residence under the Canadian Experience Class. The Canadian Experience Class is a new immigration program aimed to help temporary foreign workers and foreign students to use their managerial, professional, technical or trade work experience towards their applications for residency. The time that International students and skilled workers spend in Canada while contributing to Canadian society will now assist in their eligibility to stay permanently.
International Students

  • At least two years post-secondary education in Canada and
  • One year full–time Canadian skilled work experience in specific job categories and
  • Language proficiency (English or French) needed for occupation.

Temporary Foreign Workers

  • At least two years of recent [in the last 3 years] full-time Canadian skilled work experience in specific job categories and
  • Language proficiency (English or French) needed for occupation.

The Immigrant Investor Program seeks experienced business people to invest C$800,000 into Canada’s economy and become permanent residents. Investors must:

  • show that they have business experience

The Entrepreneur Program seeks to attract experienced business persons who will own and actively manage businesses in Canada that contribute to the economy and create jobs.

  • participation at a world-class level in cultural activities or athletics
  • farm management experience or

Family Immigrants

You can sponsor relatives or family members from abroad if they are:

  • spouses, common-law or conjugal partners 16 years of age or older;
  • parents and grandparents;
  • dependent children, including adopted children;
  • children under 18 years of age whom you intend to adopt;
  • children under guardianship;
  • brothers, sisters, nephews, nieces or grandchildren who are orphans; under the age of 18 and not married or in a common-law relationship; or
  • you may also sponsor one relative of any age if you do not have an aunt, uncle or family member from the list above who you could sponsor or who is already a Canadian citizen, or permanent resident.

A son or daughter is dependent when the child:

  • is under the age of 22 and does not have a spouse or common-law partner;
  • is a full time student and is substantially dependent on a parent for financial support since before the age of 22, or since becoming a spouse or common-law partner (if this happened before age 22); or
  • is financially dependent on a parent since before the age of 22 because of a disability.

Co-Signers
If the sponsor’s income is not enough and under the Low Income Cut-Off point, the sponsor’s spouse or common-law spouse, is allowed to co-sign the financial undertaking, in order to have their income added to the sponsor’s. Co-signers are equally responsible for supporting the sponsored immigrant, and are jointly liable if there is a default in the agreement.

Provincial Nominee Program
Under the Provincial Nominee Program, each province is allowed to select or nominate an immigrant who will potentially contribute to the particular labour and economic needs of that specific province. Each province may establish its own selection criteria and procedures to select such immigrants according to their ability to get integrated and successfully settled in that province.
Applicants must have an intention to continue residing in the province in which they apply. After an applicant has been nominated under the program, the province will issue a Provincial Nominee Certificate to the applicant.
The applicant then must apply for Permanent Residency.
Applicants must also keep in mind that Citizenship and Immigration Canada makes the final decision on admissibility. The applicant must satisfy security, criminal, and medical requirements.
